These Terms and Conditions apply to all purchases made on dropdead.world, regardless of where you are located. Where you are based in the United Kingdom, European Union, or elsewhere in the world, specific provisions apply as set out below. Please read these Terms carefully before placing an order.
1. Definitions
1.1 "Buyer" means the individual or organisation who buys or agrees to buy Goods from the Seller.
1.2 "Consumer" means a natural person acting for purposes wholly or mainly outside their trade, business, craft or profession.
1.3 "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods, incorporating these Terms and Conditions.
1.4 "Goods" means the articles that the Buyer agrees to buy from the Seller.
1.5 "Seller" means Drop Dead Clothing Limited, a company registered in England and Wales (Company No. 06036816), with registered address at 4A Rutland Road, Sheffield, S3 8DG, United Kingdom.
1.6 "Terms and Conditions" means these terms and conditions of sale, as updated from time to time.
1.7 "Website" means www.dropdead.world.
1.8 "EU Customer" means a Buyer who is habitually resident in a member state of the European Union.
1.9 "UK Customer" means a Buyer who is habitually resident in the United Kingdom.
2. Conditions
2.1 Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer under applicable law.
2.2 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.3 Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions.
2.4 Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller.

3. Ordering
3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
3.2 Where Goods ordered by the Buyer are not available from stock, the Buyer shall be notified and given the option to either wait until the Goods are available or cancel the order and receive a full refund within 14 days.
3.3 A legally binding contract between the Seller and Buyer is formed when the Seller sends an order confirmation email. The Buyer should retain this for their records.
3.4 The Seller will store a record of the Buyer's order. The Buyer may access their order history by logging into their account on the Website.
4. Price and Payment
4.1 The price of the Goods shall be that stipulated on the Website at the time of ordering. Prices are inclusive of applicable VAT where required by law.
4.2 The total purchase price, including applicable taxes and delivery charges, will be displayed in the Buyer's shopping cart prior to confirming the order.
4.3 For EU Customers: prices displayed include applicable duties and taxes at checkout. These are collected at point of sale and paid directly to the relevant customs authority via the Seller's courier.
4.4 After the order is received, the Seller shall confirm by email the details, description, price, and applicable taxes for the Goods, together with information on the right to cancel.
4.5 The Seller reserves the right to periodically update prices on the Website. Price changes will not affect orders already confirmed.
5. Import Duties, Taxes and Customs
5.1 Drop Dead Clothing Limited is a UK-based business. All orders are dispatched from the United Kingdom.
5.2 The treatment of import duties and taxes at checkout depends on the Buyer's delivery country. The Seller operates two models:
Delivered Duty Paid (DDP) countries
For customers in the following countries, all applicable import duties, taxes, and fees are calculated and collected at checkout. No further charges will be due upon delivery:
- United Kingdom
- United States of America
- Canada
- European Union: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden
For EU customers: from 1 July 2026, the EUR 150 de minimis customs threshold was removed. All duties and import taxes collected at checkout are paid directly to the relevant customs authority via the Seller's courier. The price displayed at checkout is the total price due, inclusive of all applicable duties and taxes.
Delivered Duty Unpaid (DDU) countries
For customers in all other countries, duties and import taxes are not collected at checkout. The order total shown does not include import duties or local taxes. These charges are levied by the destination country's customs authority and are the Buyer's responsibility to pay upon or before delivery. DDU countries include but are not limited to:
- Japan
- Brazil
- Australia
- Iceland, Norway, Switzerland
- All other international markets not listed under DDP above
The Seller has no control over these charges and cannot predict their amount. Buyers are strongly encouraged to check with their local customs authority before placing an order.
5.3 The Seller will clearly indicate at checkout which model applies based on the Buyer's delivery address.
5.4 Refusal to pay customs charges or to accept delivery of a DDU shipment does not automatically entitle the Buyer to a refund. Where a parcel is returned to the Seller due to non-payment of duties or non-collection, the Seller will deduct any return shipping costs and duties incurred from any refund due.
6. Delivery
6.1 Goods supplied within the UK will normally be delivered within 7 days of acceptance of order.
6.2 Goods supplied to the European Union will normally be delivered within 14 days of acceptance of order, subject to customs clearance times.
6.3 Goods supplied to the rest of the world will normally be delivered within 21 days of acceptance of order.
6.4 All delivery timelines are estimates only and are subject to stock availability. The Seller will notify the Buyer if an item is unavailable or if a delay is anticipated.
6.5 Delivery shall be made to the address specified in the order. The Buyer shall make all arrangements necessary to take delivery of the Goods.
6.6 Risk in the Goods shall pass to the Buyer upon delivery.
6.7 If delivery is delayed due to circumstances outside the Seller's reasonable control (including customs delays), the Seller will notify the Buyer as soon as reasonably practicable.
Pre-Order Items
6.8 Where a product is listed as a pre-order, the delivery timelines in clauses 6.1 to 6.3 do not apply. Estimated dispatch dates for pre-order items are stated on the relevant product page and are subject to change.
6.9 Pre-order items may be cancelled at any time up until the point at which the order has been fulfilled and dispatched. To cancel a pre-order, the Buyer must contact the Seller at help@dropdead.co quoting their order number. Once a pre-order has been fulfilled and dispatched, it is subject to the returns process set out in Section 10.
7. Order Cancellation
7.1 An order may be cancelled at any time prior to the point at which it has been fulfilled and dispatched. To cancel an order, the Buyer must email help@dropdead.co with their order number and a clear statement that they wish to cancel. Cancellation requests submitted by any other method cannot be guaranteed to be actioned in time.
7.2 Once an order has been fulfilled and dispatched, it can no longer be cancelled. The Buyer must instead follow the returns process set out in Section 10.
7.3 Where a valid cancellation request is received before fulfilment, the Seller will cancel the order and issue a full refund to the original payment method. The refund will be processed at the point of cancellation and the Buyer should expect to receive funds within 10 days, depending on their payment provider.
Pre-Order Cancellations
7.4 Pre-order items may be cancelled at any time up until the point of fulfilment and dispatch. The same cancellation process applies: email help@dropdead.co with the order number. Refunds for cancelled pre-orders will be processed within 10 days.
Statutory Rights (UK and EU Consumers)
7.5 UK Consumers have statutory cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. EU Consumers have statutory cancellation rights under the EU Consumer Rights Directive (2011/83/EU). Where an order has already been dispatched, these rights are exercised through the returns process in Section 10, which is consistent with the statutory 14-day return window.
7.6 Nothing in this section limits the Buyer's statutory rights under applicable law.
8. Exceptions to the Right to Cancel
The right to cancel prior to fulfilment does not apply to:
- Goods made to the Buyer's specifications or clearly personalised.
- Goods which are liable to deteriorate or expire rapidly.
- Sealed goods which are not suitable for return due to health protection or hygiene reasons, where the seal has been broken after delivery.
Once an order has been fulfilled and dispatched, cancellation is not possible and the Buyer must use the returns process in Section 10.
9. Faulty or Incorrect Goods
9.1 The Buyer shall inspect the Goods upon receipt and shall notify the Seller by email within a reasonable time if the Goods are damaged, defective, or incorrect.
9.2 Where a valid claim of defect or damage is made, the Seller will offer the Buyer a repair, replacement, or full refund (including delivery costs and reasonable return postage) at the Seller's discretion.
9.3 UK Consumers have rights under the Consumer Rights Act 2015. EU Consumers have rights under the Sale of Goods Directive (EU) 2019/771. Nothing in these Terms and Conditions limits those statutory rights.
9.4 Goods must be returned within 28 days of the Seller accepting a valid faulty goods claim.
10. Returns
10.1 Returning an order after dispatch
Once an order has been fulfilled and dispatched it cannot be cancelled. If the Buyer wishes to return the Goods, a return must be raised through the Seller's returns portal within 28 days of the delivery date.
Returned Goods must meet all of the following conditions:
- Unworn and unwashed.
- In the same condition as when delivered.
- In their original packaging.
Failure to meet these conditions will result in the Goods being returned to the Buyer at their cost and no refund being issued.
Where a return is accepted, the Seller will process the refund to the original payment method within 10 days of the returned Goods being received back at the Seller's warehouse.
10.2 Exchanges
Where an exchange is appropriate and the requested item is in stock, the Seller will process an exchange in place of a refund. Exchanges are subject to stock availability. The Buyer is responsible for return postage costs.
10.3 How to raise a return
All returns must be raised through the returns portal on the Website. Returns raised by email or any other method outside of the portal may not be processed. The portal link is available at dropdead.world.
11. Data Protection and Privacy
11.1 The Seller processes personal data in accordance with applicable data protection law, including:
- For UK Customers: the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
- For EU Customers: Regulation (EU) 2016/679 (the GDPR).
11.2 The Seller collects and processes personal data (including name, address, email, payment information, and browsing data) for the purposes of fulfilling orders, managing customer accounts, providing customer support, and where consent has been given, for marketing communications.
11.3 The Seller does not sell personal data to third parties. Data may be shared with third-party service providers (such as payment processors, courier services, and marketing platforms) where necessary to fulfil the Contract.
11.4 Buyers have rights in relation to their personal data including the right to access, rectification, erasure, restriction, portability, and to object to processing. Requests may be submitted to: support@dropdead.world.
11.5 Where personal data is transferred outside the UK or EU, the Seller ensures appropriate safeguards are in place in accordance with applicable data protection law.

12. Limitation of Liability
12.1 Except as required by applicable law, the Seller's total liability to the Buyer shall not exceed the price paid for the Goods in question.
12.2 The Seller shall not be liable for any indirect, incidental, or consequential loss or damage.
12.3 Nothing in these Terms and Conditions excludes or limits the Seller's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability which cannot be excluded by law.
12.4 For EU Consumers, nothing in these Terms and Conditions reduces the Buyer's statutory rights under applicable EU consumer protection law.
13. Alternative Dispute Resolution
13.1 If a dispute arises between the Seller and a Consumer Buyer and cannot be resolved through the Seller's complaints process, the following options are available.
13.2 UK Customers may refer disputes to an approved Alternative Dispute Resolution (ADR) provider. Details of ADR schemes approved by the Seller will be provided on request.
13.3 EU Customers have the right to use the European Commission's Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr. The Seller's email address for ODR purposes is: support@dropdead.world.
13.4 The Seller is not obliged to participate in ADR proceedings but will consider doing so in good faith.
14. Waiver
No waiver by the Seller (whether express or implied) in enforcing any of its rights under this Contract shall prejudice its rights to do so in the future.
15. Force Majeure
The Seller shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, accidents, war, fire, failure of communications or computer systems, breakdown of plant or machinery, or shortage of raw materials. The Seller shall be entitled to a reasonable extension of time to perform its obligations.
16. Severance
If any term or provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by any court of competent jurisdiction, that provision shall be severed and the remainder of these Terms and Conditions shall continue in full force and effect.
17. Changes to Terms and Conditions
The Seller may update these Terms and Conditions from time to time. Changes will be published on the Website with an updated date. Changes will not affect orders placed prior to the updated Terms being published.
18. Governing Law and Jurisdiction
18.1 These Terms and Conditions are governed by and construed in accordance with the law of England and Wales.
18.2 For UK Customers: disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
18.3 For EU Customers: nothing in this clause affects the Buyer's rights to bring proceedings in the courts of their country of habitual residence, as provided under applicable EU law (including the Brussels I Recast Regulation).
